(Updated June 4, 2008) The Czech Supreme Court is to decide if the statute of limitations has run out on the judiciary murder of Milada Horáková 58 years ago, and if her prosecutor, Ludmila Brož Polednová, can still go on trial, Tyden.cz reported Wednesday.
"I greatly value the cooperation of the secret police, thanks to which the trial turned out well," Polednová said following the 1950 trial, which resulted in the hanging of four "enemies of the state," including Horáková. The prosecutor is now 86 years old.
This is the third time that Polednová has been on trial for her role in the murder of Horáková. Last November, the Prague Municipal Court sentenced her to eight years in jail.
"She was not just a passive participant," Judge Petr Braun said at the time.
However, the Supreme Court in Prague overturned the verdict, saying the prosecutor had merely been an accessory to the murder, and not a murderer, and that the statute of limitations had run out on the crime.
State Prosecutor Renata Vesecká appealed that verdict to the Czech Supreme Court, which can either return the case to the lower court or concur with it.

add your commentBeing that you are trying individuals who committed horrendous crimes under communism...and now the statute has run out ..
What is that statute based on -- the time of when these acts were discovered?
The European Union in Brussels will appreciate your efforts.
How many people suffered? Even though your defendant is now 86 years old she needs to pay the price.
We must have public policy to show others that it will not be tolerated!
Good luck to you!
